The fifth president, member of parliament, and leader of “European Solidarity” Petro Poroshenko filed a lawsuit against the Secretary of the National Security and Defense Council, Oleksandr Lytvynenko.

It is noted that on May 22, Petro Poroshenko’s lawsuit was submitted to the Vinnytsia District Administrative Court.

The essence of the lawsuit is the recognition of the unlawful actions of the head of the NSDC related to the “rewriting” of the appendix to the “sanctions” presidential decree dated February 12, 2025. By this decree, Volodymyr Zelensky enacted the NSDC decision on the application of indefinite personal sanctions against five individuals: oligarch Ihor Kolomoisky, his business partner Hennadiy Boholiubov, fugitive businessman Kostyantyn Zhevago, MP Petro Poroshenko, and Putin’s close associate, former MP Viktor Medvedchuk.
After the publication of this decree, it became known that an error had crept into the “sanctions” profile, specifically, an incorrect taxpayer identification card registration number was indicated, consisting of 11 digits instead of 10.

According to Petro Poroshenko’s lawyer, Stanislav Kunyansky, when reports about the error in Zelensky’s decree appeared in the public domain, after some time a corrected version of the appendix was uploaded on the president’s website. This was done based on a letter from Oleksandr Lytvynenko. At the same time, the NSDC did not convene on this matter again, did not vote on any changes, and the president did not enact such changes by his decree.

“In other words, the Secretary of the NSDC, without any voting or proper formalization, unilaterally made a decision based on which the corresponding NSDC decision was published not in the version in which it was actually approved. The Secretary of the NSDC did not have the authority to take such actions. At the same time, according to the current practice of the Supreme Court, the indication of incorrect personal data renders the sanctions null and void. That is, the sanctions against Petro Poroshenko, in the form in which they were actually approved, did not create any legal consequences (referring to the error in the identification code – editor’s note),” emphasized the lawyer.

In addition, Stanislav Kunyansky spoke about another inaccuracy related to the introduction of sanctions, which Poroshenko’s defense learned about during the consideration of the former president’s lawsuit against the current head of state, Volodymyr Zelensky. Specifically, in the Supreme Court, the president’s side insisted that the “sanctions” decree was officially published on February 14, 2025. However, as early as February 13, 2025, information about Petro Poroshenko appeared on the State Sanctions Registry website, which is administered by the NSDC Office.
“That is, the sanctions came into effect even before the official publication of the decree, which is also a significant violation and a clear demonstration of the haste and legal clumsiness with which these sanctions were prepared and approved,” the lawyer for Poroshenko believes.
