📝 How to appeal a fine for violating military registration and what you should know

🚨 In wartime, the issue of compliance with military registration rules in Ukraine becomes increasingly relevant. Ignoring these rules can lead to serious legal consequences, including significant fines for military personnel.

⚖️ However, citizens can appeal the administrative penalty in the form of a fine imposed by the Territorial Centers for Recruitment and Social Support (TCRSS). OBOZ.UA explains under what conditions this is possible.

👮‍♂️ During the war, Territorial Centers for Recruitment and Social Support actively monitor compliance with military registration rules by military personnel. Those who violate these rules can be held administratively accountable. However, it is common for TCRSS employees to abuse their authority and impose fines unlawfully. Therefore, when there are grounds for appeal, such fines can be contested.

💡 Administrative liability is based on:

– Article 210 of the Code of Administrative Offenses (Violation by conscripts, military personnel, and reservists of military registration rules) – fines ranging from 17,000 to 25,500 UAH.

– Article 210-1 of the Code of Administrative Offenses (Violation of defense legislation, mobilization preparation, and mobilization) – fines ranging from 17,000 to 25,500 UAH.

💼 A monetary fine can be imposed for the following violations:

– Not being registered at the place of residence.

– Not being registered at the place of work or study.

– Ignoring a summons delivered personally or sent by mail.

– Ignoring a referral for a military-medical commission.

– Failing to notify the district TCRSS of changes to personal military registration data or residence.

– Failing to update military registration data on time.

– Avoiding conscription for military service.

📑 What is the procedure for imposing a fine?

According to the Inseinin portal, administrative liability involves the following stages: detecting the violation, drawing up a report, reviewing the case, and issuing a decision on liability.

📍 A report on the administrative offense is drawn up by TCRSS representatives in the offender’s presence. If the offender is absent, TCRSS may contact the police to locate and bring the individual for the report.

⚖️ The case is reviewed within 15 days from the report’s submission. The offender is summoned to TCRSS for the review, and based on the outcome, a decision is made to either impose a fine or close the case.

📬 How to find out about the fine?

A copy of the decision on the fine must be delivered or sent to the individual within three days. The decision does not appear in Diia or other electronic services. If the fine is not paid, enforcement proceedings may begin for forced collection. The fine can be tracked through the Unified State Register of Enforcement Proceedings or the Diia portal.

⏳ The individual has 30 days to pay the fine. If ignored, the case is transferred to enforcement services for compulsory execution, and the fine amount is doubled. Within enforcement proceedings, bank accounts can be blocked until the fine is paid. Additionally, assets may be seized to cover the fine.

⚖️ How to appeal a fine from TCRSS?

Only the decision to impose a fine can be appealed. The report on the violation or the search request cannot be appealed.

👨‍⚖️ To appeal the fine, a lawsuit must be prepared and submitted to the court within 10 days at the place of the claimant’s or defendant’s location.

📝 If the decision was received late, the statement should also include a request to restore the missed appeal deadline. After the case is opened, the court decides whether to annul the decision and close the administrative case.

💼 According to human rights defenders, it is important to go to court only if there are valid grounds for appeal.

⚖️ Grounds for appealing a TCRSS fine include:

– Lack of an administrative offense.

– Missed deadline for liability.

– Presence of procedural violations.

💼 Lawyers emphasize that each case is unique, so it is essential to carefully review all materials and evidence to determine whether there are grounds to appeal the fine.
