In Ukraine, due to the full-scale Russian invasion, martial law and general mobilization are in effect, under which men aged 25–60 are being drafted into the military. However, certain categories of citizens can obtain a deferral or exemption from conscription.

For individual entrepreneurs (FOPs), the law does not directly provide a deferral for running a business. At the same time, FOPs can avoid conscription if their activity is critically important for the economy or public life, or if the person has medical restrictions for service, according to lawyers from INSEININ.
To obtain a deferral, the business must meet the Cabinet of Ministers’ criteria and submit an application to the Ministry of Economy or local authorities with supporting documents:
- Contracts with state or municipal enterprises;
- Documents proving tax payments, showing contribution to the budget;
- Certificates of the number of jobs created.
After review, the business can be included in the list of persons subject to reservation, which effectively grants a deferral from mobilization.
Additionally, deferrals can be granted on other grounds:
- Medical restrictions confirmed by a military medical commission;
- Three or more minor children;
- Single parents or guardians of a child with a disability;
- Educational or scientific activities;
- Work in strategic state institutions.
Lawyers emphasize that the procedure for obtaining a deferral is complex and requires properly prepared documents and official review of the application.
