Martial law in Ukraine will continue at least until February 3, and mobilization continues alongside it. At the same time, legislation clearly defines the categories of citizens who are exempt from conscription or entitled to a deferment.

According to Article 23 of the Law of Ukraine “On Mobilization,” individuals who have officially received a deferment will not be mobilized. This category includes employees of critically important enterprises with valid exemptions, as well as students, scientists, and teaching staff.

In most cases, conscription does not apply to men aged 18 to 25 who have not completed mandatory military service and have not finished studies at a military department.

Also exempt from mobilization are persons with disabilities, parents of large families, single and adoptive parents. Deferments are granted to men raising children with disabilities or serious illnesses, as well as those providing constant care for a wife, parents, or other relatives with disabilities.

Separately, the law provides exemption from mobilization for military personnel released from captivity — they may return to service only voluntarily. Close relatives of deceased or missing servicemen, including parents, sons, brothers, and husbands, are also exempt from conscription.

Furthermore, mobilization does not apply to persons deemed unfit for military service due to health reasons. According to Ministry of Defense Order No. 402, this decision is made by a military medical commission.
