Martial law and general mobilization continue in Ukraine; however, certain categories of persons liable for military service may receive a deferment from conscription. One of the grounds is caring for a sick wife. This was explained by lawyer Yurii Aivazian on the “Yurysty.UA” portal.

Deferment for caring for a wife
Among the most common reasons for obtaining a deferment is caring for close relatives. If a man is caring for his wife who requires medical assistance, the presence of adult children in the family does not affect the chances of receiving a deferment.

“The presence of an adult child is not grounds for refusing to grant a deferment to a husband,” the lawyer noted.

At the same time, the requirement to confirm the absence of other relatives who can provide care applies only in cases of caring for the wife’s parents, under paragraph 9 of part one of Article 23 of the Law of Ukraine “On Mobilization Preparation and Mobilization.”

Required documents for deferment
To obtain a deferment for caring for a sick wife, a person liable for military service must submit the following documents to the CNAP (originals or certified copies):

passports and tax identification numbers of the husband and wife;

marriage certificate;

the husband’s military registration document;

Appendix 8 or a certificate confirming receipt of compensation for non-professional care;

a document confirming the wife’s need for constant care, in particular a conclusion from the medical advisory commission (LKK).
